Terms of Service
Effective date: October 15, 2026
These terms govern your use of the Elite Epoxy LLC website and customer portal, including estimate and proposal links. Elite Epoxy LLC is a residential and commercial floor-coating contractor in Wichita, Kansas. By using the site or portal, you agree to these terms.
Website and proposal links
Use the site only for lawful purposes and provide accurate contact and project information. Do not interfere with the site, attempt unauthorized access or submit information you are not authorized to share. Keep your private proposal link secure and share it only with people authorized to review or approve your project.
We permit you to use the website and portal for requesting, reviewing and approving services and managing your project. This permission does not transfer ownership of our website or its content. The site may be unavailable from time to time for maintenance or other reasons.
Estimates and the written proposal
Estimates are proposals for the described work, not a guarantee that every possible site condition has been identified. Your written proposal governs the job, including scope, materials, price, exclusions and any project-specific terms. If these website terms conflict with the written proposal about the work, the written proposal controls. Changes to scope or price must be agreed in writing.
Electronic acceptance
Accepting a proposal through its approval link is your electronic signature and indicates your agreement to that written proposal. By approving, you confirm that you are authorized to accept the work for yourself or the business you represent and consent to electronic records of that approval.
Deposits and payments
A 50% deposit is due on approval before materials are ordered. The remaining balance is due on completion. Materials must be ordered before the job is scheduled. Payment instructions will be provided with your invoice. Online payments made through QuickBooks payment pages are handled by Intuit and are subject to its applicable payment terms.
Scheduling and site access
Scheduling is coordinated with you after the deposit is received and materials are ordered, and depends on material availability, site readiness and conditions suitable for the selected coating system. We will communicate any changes to the agreed schedule.
You are responsible for providing safe access to the work area, clearing the area as agreed and informing us of known slab, moisture, utility or other site issues. Follow the access and return-to-service instructions provided for your specific floor. Unexpected conditions or unavailable access may require a revised scope or schedule.
Warranties
Any warranty for the work is limited to the terms stated in your written proposal and any rights that cannot be excluded by law. Website descriptions, photos and sample displays do not create additional warranty terms.
5-Year Limited Warranty
Elite Epoxy provides a 5-year limited warranty for its residential and commercial epoxy floor coatings under the following conditions:
Residential garages: The warranty covers peeling and delamination of the coating from the concrete for up to 5,000 square feet of floor area, provided the original purchaser owns the home. The warranty also covers resistance to hot tire markings and stains from incidental oil, radiator fluid, gasoline and diesel, provided spills are cleaned within 20 minutes.
Commercial/industrial buildings: Epoxy coatings in commercial, industrial or business-use buildings (up to 5,000 square feet) are warranted against faulty installs, peeling, delamination, and stains from incidental oil or fluid spills for three years, as long as spills are cleaned within 20 minutes.
Exclusions: This warranty does not cover damage due to normal wear and tear, improper maintenance, misuse or neglect.
Limitation of liability
To the extent permitted by law, Elite Epoxy LLC is not liable for indirect, incidental, special or consequential damages arising from use of this website or portal, including loss caused by interruptions or unauthorized use of a proposal link. Responsibility for the contracted work is governed by the written proposal and applicable law. Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.
Governing law and updates
These terms are governed by the laws of Kansas, subject to any mandatory applicable law. We may update these website terms by posting a revised version with a new effective date. Updates do not change an already accepted written proposal unless agreed in writing.
